Question # 1: What is a "Communications Strategy"?

It takes its cues from the marketing strategy, which, in turn, takes its direction from the business strategy....A communication strategy, then, is one component of the marketing strategy. Its purpose is simple: it supports the marketing strategy and, by association, the business strategy.

Perhaps it’s best to return to the military metaphor. If the general has decided victory is necessary in a certain country, the marketing strategy would pinpoint the locations necessary to achieving that victory. Initial reaction:

1. The City of Lakewood prevailed in Skindell v. Madigan by misrepresenting the facts associated with the decision-making of Lakewood City Council and by the filing of a materially false affidavit during the appeal to the Ohio Eighth Circuit Court of Appeals.

2. This was a successful strategy because the City of Lakewood used their violations of the public records laws as a shield to hide (for 2 years) the actual documentation of the violations of the open meeting laws.

Astounding! Outrageous! Completely Nixonian.

Question # 2: Here's the $100M Question: Can anyone determine from the attached document, what City Council had decided and agreed upon as its "organizational objective" and its "business strategy' on November 30, 2015?


Here are a few hints:

1. Please note that the "Communications Strategy" document above mentions an "agreement" six times.

2. Councilman O’Leary stated at the December 7, 2015 press conference (which was referenced in the "Communications Strategy" document): “This new agreement funds our future and a vibrant new downtown district. Specifically, this agreement means the Cleveland Clinic will invest $34 million in a new modern family health center and emergency department…demolishing the old parking garage is part of the agreement.” [emphasis added]. "Soldier" O'Leary was following the directions of the "General" here as part of the communications strategy.


3. On April 6, 2015, at a Lakewood City Council Committee of the Whole Meeting, Messrs. Butler and O'Leary had a chat about the "agreement":

Mr. O’Leary” “It’s certainly been strongly suggested that there’s a draft or something closely resembling a draft of the definitive agreement as they [the Clinic] see it.

Law Director Butler: “Yes…Yes...”

Mr. O’Leary (later at about 53:00): “It seems to me that it could save a lot of time in this process if rather than going into extraordinary detail discussing a letter of intent which contemplates an agreement that’s in fact already in existence if we were to just sit down with the agreement that’s already in existence and start to analyze that as a starting point rather than…

Law Director Butler (interrupting O’Leary): “Yeah, I’m not disagreeing with you…

4. On December 21, 2015, in the Skindell v. Madigan case concerning open meetings, Mr. O’Leary testified concerning the Master Agreement: “That agreement didn’t exist yet so it wasn’t being deliberated.” (Tr. 63:12-13-- Note: references to Tr. ___ are be references to the Transcript of the December 21, 2015 hearing in Skindell v Madigan which is attached.) “The agreement that was announced on December 7th did not exist when it was announced and, therefore, it is correct to say the council had not deliberated on the definitive agreement that wasn’t in existence yet, absolutely.” (Tr. 63:18-22).

So as of April 6, 2015, both O’Leary and Butler agreed that a draft of the “definitive agreement”, also known as the Master Agreement existed, but on December 21, 2015 O'Leary testified it did not exist.

Enough hints.

It appears that the Mayor and a captive City Council already had an AGREEMENT IN HAND to close Lakewood Hospital and take all of its monies, all of its equipment, all of its human capital, all of its assets, and all of its endowments and divide them between the Clinic and their new private foundations. #AmIWrong?

That's a Bingo!

I just awoke from a nap to resume review of the 27,000 pages of public records and Lakewood's 844 page filing with the Court on Monday, including Butler's 29 page sworn affidavit--a treasure trove of lies by public officials.

Now that we have established that at least as early as November 30, 2015, the 2015 City Council adopted a "communications strategy" to achieve the "organizational objective" and "business strategy" of an "agreement" to close Lakewood hospital, we can now assemble and examine the mounting evidence that this was all done outside of public meetings.

In this regard, please note that Mr. McEwen's statement from early December, 2015 (before the December 21, 2015 "vote") is most helpful: "City Council is a 7-member communications army." McEwen's admission tracks closely the authority I cited above about the "military metaphor" about the "communication strategy" focusing on "the smaller strategies required to obtain those locations and provide direction to the soldiers [i.e. Council members] .....assigned with taking those locations [i.e delivering key agreed upon messages in the strategy to sell the agreement]."

Stay tuned as I will demonstrate with public records in Butler's own hand, the illegal "communications strategy" was orchestrated and led by none other than Butler and hatched as early as June, 2015.
